Terms of Sale

Murco Recycling Enterprises, Inc. (“Murco”) brokers the sale of used building materials, appliances, fixtures, and furnishings, often directly from homes scheduled for renovation or tear-down. Murco may act on behalf of the material owner. These terms apply to purchases arranged through Murco’s website, listings, email, or direct communication. Any terms specific to an item, written offer, or invoice also apply to that purchase.

Listings and availability

Most materials are used and remain at a project site until removal. Listings may show a minimum asking price, which is an invitation to make an offer, not a promise to sell at that amount. If more than one buyer is interested in an item at the minimum asking price, the item is subject to auction, and the high bidder is awarded the item. Submitting an inquiry or offer does not reserve an item. A sale is confirmed only when Murco accepts the offer in writing and the buyer pays the amount or deposit required by the invoice.

Availability, descriptions, measurements, model information, condition, and removal dates are based on information available when posted and may change. If a material change affects an item before the sale is completed, Murco will notify the buyer so they can decide whether to proceed.

Prices, buyer’s premium, and delivery

Murco charges a 10% buyer’s premium, a customary fee in the auction industry. The premium is retained by Murco to cover administrative costs and is generally included in the stated purchase price unless the listing or written invoice specifies otherwise.

Delivery is the buyer’s responsibility and is an additional charge. Murco is happy to help arrange delivery when requested. The listing or written invoice will identify the purchase price and any agreed delivery or other charges before the buyer commits.

Payment and deposits

Murco accepts credit cards, ACH payments, Zelle, and PayPal. Murco will confirm the accepted price, payment due date, and any deposit in writing. An item is not held or scheduled for removal until the required payment or deposit has been received. If a buyer does not pay by the agreed deadline, Murco may cancel the sale and offer the item to someone else. Any deposit terms, including whether and when a deposit may be refunded, will be stated in the written offer or invoice.

Condition and inspection

Materials are sold as is, where is, in their existing condition, subject to any specific written representations made by Murco. Used materials may show wear, alterations, missing parts, or conditions that are not visible in photos. Measurements are approximate. Buyers should review the listing, ask questions, and request an inspection before purchasing when an inspection can be arranged.

The buyer is responsible for determining whether an item will fit and work for its intended use, including installation, code, electrical, plumbing, and appliance compatibility. Murco does not provide an installation warranty or guarantee that a used item will meet the buyer’s project requirements.

Removal, pickup, and delivery

Many items are sold while still installed. Murco will explain whether professional removal is included in the quoted price and will coordinate removal when specified in the sale. Site access and project schedules may affect timing. Buyers may not enter a property, remove materials, or arrange their own contractor without Murco’s prior written approval.

Pickup, delivery, shipping, and storage arrangements must be agreed upon before the sale is completed. Delivery is at the buyer’s expense, even when Murco helps arrange it. Unless the written sale terms say otherwise, installation at the buyer’s property is not included.

All sales are final

In general, all sales are final. Because materials are one of a kind and removal is often tied to a renovation schedule, buyers should resolve questions about condition, measurements, and suitability before purchasing. If an item becomes unavailable, cannot be removed as described, or differs materially from a specific written description before handoff, contact Murco promptly. Murco will review the circumstances and the agreed sale terms and arrange an appropriate resolution, including a refund of amounts paid for an item Murco cannot provide. This section does not limit rights that cannot be waived under applicable law.
